Doran haiz orat sy nikkah jaiz aur darust hai. is mai qatan koi harj nahi hai, is liye k uqad nikkah mai asal cheez iska halal aur sahi hona hai. jab k halat haiz mai tehreem nikkah ki koi daleel nahi. agar sorat haal iss tarhan ki ho to nikkah darust hai aur is mai koi harj nahi. yahan nikkah aur talaq k mabain farq ko samjhna zarori hai. doran haiz talaq daina najaiz balky haram hai. Jab Rasool Allah (S.A.W) ko yh baat pohanchi k Abdullah bin umer R.A. ny apni bivi ko haiz k doran mai talaq di hai to App (S.A.W) sakht naraz huway aur issy hukam dia k woh bivi sy roju kary, phir agley tuher tak issy chory rakhy, phir chahey to issy talaq dy dey aur agar chahy to rok ley.
sahi albukhari' hadis:5251' wa sahi muslim' hadis: 1471.
Aur Allah Ta'ala ka Irshad hai:
"Aye Nabi! (logo sy keh dijeye k) jab tum apni biviyon ko talaq daina chaho to in ki edat mai inhain talaq do aur edat ka hisab rakho aur Allah sy darty raho jo tumhara perwardigar hai, na tum inhain in k gharon sy nikalo aur na woh khud niklain bajuz is sorat k ky woh khuli behayai ker bethain. Yh Allah Ta'ala ki muqarer kerdah hadain hain aur jo shakhs Allah Ta'ala ki hadod sy tajawuz keryga yaqinan woh apny app per zulem keryga."
Attalaq 65:1.
Lehaza doran haiz talaq daina ya is tuher mai jis mai khawand bivi sy jama'a ker chuka ho jaiz nahi hai, siwaye is sorat k ky hamal zahir hojaye. aur agar hamal zahir hojaye to jab chahey talaq dey sakta hai, yh talaq waqai hojaye gi. aam logo mai aik ajeeb-o-gareeb baat mashor hai k doran hamal di gae talaq yaqey nahi hoti, yh bat darust nahi hai. hamla orat ko di gae talaq moaser hojati aur tamam talaqo mai mudet k aitbar sy yh ziada wasee talaq hai, lehaza hamla orat ko talaq daina admi k liye halal hai. agarcha is ny qareebi arsa mai is sy jama'a bhi kia ho. lekin agar is ny gair hamla orat sy kuch hi arsa qabal jama'a kia ho to phir is per intezar kerna zarori hai hatta k orat haiza hojaye aur phir pak ho ya yh hamal wajeh hojaye. Sarat Talaq mai irshad bari Ta'ala hai:
"aur hamla orton ki edat waza'a hamal hai."
At'talaq 65:4.
Yh is amar ki wajeh daleel hai k doran hamal di gaye talaq waqey hojati hai. Hazrat Abdul Allah bin umer R.A. ki hadis mai youn bhi hai k App (S.A.W) ny Hazrat umer R.A. sy farmaya:
"Issy hukam do k woh is sy roju kery, phir tuher ya hamal ki halat mai issy talaq dey."
sahi muslim' hadis: (5)-1471' wa jamia At'tramzi' hadis: 1176.
jab yh bat wazeh hogaye k doran haiz orat sy nikkah kerna jaiz aur sahi hai to meri rai mai khawand ko tuher tak bivi k pass nahi jana chaheye, is liye k agar woh tuher sy pehly is k pass jaye ga to is baat ka khatra hai k shayeed woh apny app per control na ker saky, woh kahiin doran haiz mamnu kaam ka irtekab na ker bethy, khas tour per jab woh jawan ho, to issy tuher tak intezar kerna chaheye jab bivi is haal mai ho k khawand sharamgah sy lutf andoz ho sakta ho.
