Answer :
App per yh wajib hai k yh raqam varison ko dey den, app variso ki raza mandi k bagiar sadqa nahi ker sakty, haan, albatta agar apki waldah ny vasiyet ki hu aur is vasiyet k 2 adil guwah majood houn aur vasiyet kul tarka ki aik tahai k braber ya is sy kam hu to phir vasiyet per amal kerny k paish-e-nazar app sadqa ker sakty hain. MUTALQA ORAT K LIYE MIRAS

Question :
Khawand ny apni bivi ko talaq dey di, woh eddat guzar rahi thi ya guzer chuki thi k achanak khawand ka inteqal hugaya. kia is sorat mai orat khawand k terka ki waris ban sakti hai?
Answer :
Agar mutelqa orat ka khawand eddat k ander mar gaya to yh talaq do haal sy khali nahi: ya to woh talaq raje hogi ya gair rajee. Agar talaq rajee hai to orat ekhtatam eddat tak bivi k hukam mai hai woh khawand ki wafat k baad talaq ki eddat sy wafaat ki eddat mai muntaqil hujayegi.
Talaq rajee yh hai k khawand bivi ko dakhol k baad bagair muawiza diye pehli ya dosri talaq dey day, is doran mai agar us ka khawand fout hujaye to woh uski waris hogi. Allah Ta'ala ka irshad hai:

"Aur talaq di gae ortain apny apko 3 haiz rak roky rakhen aur in k liye yh jaiz nahi k Allah TA'ala ny in k rehmo mai jo paida kia hai ussy woh chupayen, agar woh Allah aur roz-e-akhrat oer emaan rakhti hain. aur in k khawand us muddat mai in ko wapis lota lainy k ziada haqdar hain, bashart yh k eslaah aihwal ka iradah rakhty houn aur orton k bhi wasey hi haq hain jaisy un per (mardon k) haq hain."
Al Bakra 2:228.
Issi tarha irshad huwa:

"Aye Nabi! Jab tum orton ko talaq dainy lagu to in ki eddat mai inhain talaq du atu eddat ka hisab rakhu aur Allah sy, jo tumhara perwardigar hai, derty rahu, na tum inhain in k gharo sy nikalo aur na woh khud niklain bajuz is sorat key k woh khuli burai (be hayai) ka irtekab karen, yh Allah k muqarer kerdah hadain hain aur jo koi Allah ki hadon sy tajawuz karey ga to us ny apny uper zulem kia. tum nahi janty shayed k Allah TA'ala is k baad koi nai baat paida kerday."
At'talaq 65:1.
Allah Ta'ala ny mutelaqa orat ko eddat k ander khawand k ghar mai rehny ka hukam dia hai aur farmaya hai k woh nahi janti k shayed Allah Ta'ala is k baad koi nai sorat-e- haal paida farma dey, yani is ka khawand rajou ker ley.
aur agar achanak mer jany waly khawand ny bivi ko talaq baina, yani teesri talaq di hu ya bivi ny khawand sy khulaa kia hu ya woh talaq ki eddat nahi balkyfaskh nikkah ki eddat guzar rahi hu to in sab soraton mai woh khawand ki waris nahi ban sakti aur na eddat talaq sy eddat wafaat mai muntaqil hogi.Haan aik aisi sorat hai jis mai baina talaq wali orat khawand ki waris ban sakti hai, woh yh k khawand ny marz-ul-mout k doran mai bivi ko terka sy mehroom kerny k iradey sy talaq di hu. is sorat mai agarcha eddar guzer gae hu, woh phir bhi khawand k terky ki waris ban jayegi lekin is mai shart yh hai k orat ny aagy nikkah na kia hu, warna wo is sy mehrom hu jayegi. BATIL VASIYET KERNA

Question :
Mery walid ny apni mamlo k zarai zameen k muta'aliq vasiyet ki k mery merny k baad mery falaa bty k naam alaat kerdo, jab k is bety k elawah iski 4 bitiyan bhi hain kia aisa kerna jaiz hai? agar baap ki zameen ko aik bety aur 4 betiyon mai taqseem ki jaye to taqseem kaisy hogi?
Answer :
Allah Ta'ala ny Quran Majeed mai maiyet ki virasat ki taqseem ka asool biyaan farma dia hai:

"Allah tumhain tumhari olaad k muta'aliq vasiyet kerta hai, aik mard ka hissa 2 orton k hissey k braber hai."
Al nissa 4:11.
App (S.A.W) ny farmaya:

"Allah TA'ala ny her haqdar ko is ka haq dey dia hai, is liye waris k liye vasiyet nahi."
sanan abi daud' hadis:2870' wa jamia at'tramzi' hadis: 2120.
es bina per baap ki aik bety k naam vasiyet batil hai, lehaza is ka nifaz najaiz hai, haan, agar tamam sharai virsa is per apni raza mandi aur muvafqat ka izhar ker dain to phir koi harj nahi. lekin agar sharai virsa aisa na karen to is sy zarai zameen wapis laina aur tamam virsa mai Allah Ta'ala k muqarer kerdah asool k mutabiq taqseem kerna zarori hai. yh tarka tamam varison mai taqseem hoga. agar aik bety aur 4 betiyon k elawah aur koi waris na ho to

k asool k tahet tarka taqseem hoga. is khait ki qeemat taqseem ki jayegi aur maiyet ny jo 6 hissey tarky mai chorey hain to her larki ko aik hissa aur larky ko 2 hissey milen gey, yani agar virsa faqat yahi hoon to jaidad k kul 6 hissey karen gey. bety ko 2 hissey aur her her beti ko aik aik hissa milega. Question :
Aik admi fout hugaya, iski bivi hai aur bacha koi nahi, albatta fout shudah bhai ki olaad majood hai to kia us bhai k bety aur betiyan apny chacha ki waris hain?
Answer :
Agar amar waqey issy tarha hai jis tarha saeel ny ziker kia hai to sari meeras bhai k beton ko milegi betiyon ko nahi milegi aur is per tamam musalmano ka ejma'a hai Qk Nabi Akrem (S.A.W) ny farmaya:

"Faraiz (muqarer shudah hissey) is k haqdaron ko dey do aur jo baki bach rahy woh qareeb tareen mard ko dey do." (shiekh ebn baaz)

MUSALMAN' KAFIR KA WARIS NAHI HOTA

Question :
AIk maa baap k 8 bachy hain jin mai sy 4 larky hain aur 4 larkiya. yh sab aisai thy lekin ab in mai sy 3 larky aur aik larki musalman huchuky hain, in k walid ka inteqal hugaya hai aur is ny apny peechya bohat dolat chori hai jo k athara million saudi riyaal k qareeb hai to kia is matofi kafir shakhs ki musalman olaad waris hai ya nahi?
Answer :
Agar amar waqey issi tarha hai to kufer per merny waly shakhs ki musalman olaad waris nahi hogi, is masly mai asool woh hadis hai jissy Imam Bukhari-o-Muslim Rehmat ul Allah ny Hazrat Usama bin zaid R.A. sy ravayat kia hai k RAsool Allah (S.A.W) ny farmaya:

"Musalman kafir ka aur kafir musalman ka waris nahi husakta." (Fatwa cammettie)
Sahi albukhari' hadis: 6764' wa sahi muslim' hadis: 1614

GAIR MADKHOLA BIVI KI MERAS

Question :
Aik shakhs ny aik do sheeza sy shadi ki, uqad nikkah to hugaya lekin yh shakhs jinsi ta'aluqat qaeem kerny sy pehly hi fout huga, is ny terka to chora hai lekin is bivi k siwa aur koi olaad ya qareebi rishtydar ya koi waris nahi to kia yh bivi iski waris hai?
Answer :
Haan iski yh bivi jis sy is ny jinsi milaap nahi kia is ki waris hai aur yh hasb-e-zail irshad bari Ta'ala k amom sy sabit hai:

"Aur jo maal tum (mard) chor maro, agar tumhari olaad na hu to tumhari orton ka is mai chota hissa hai aur agar olaad hu to in ka athwaan hissa hai (yh hissay) tumhari wasiyet (ki takmeel) k baaad jo tum ny ki hu aur (adaye) qarz k baad (taqseem kiye jayen gey.)"
Al nissa 4:12.
Mahez uqad sahi hi sy bivi, bivi ban jati hai, lehaza jab uqad sahi hu aur khawand fout hujaye to woh is ki waris hogi aur is k liye eddat bhi lazim hogi, khuwah is k shoher ny is sy milaap na bhi kiya hu. is ko maher bhi mukammal milega aur terka mai sy is k hissay k baad jo bach rahy woh nasb k lehaz sy is shoher k qareeb tareen mard usbah ko milega lekin sorat masola mai chonkey Ashab-ul-Faroz ya usbah mai sy aur koi majood nahi hai, lehaza is orat k hissy k baad jo maal baki bach jayega woh bait-ul-maal mai jama'a kara dia jayega Qk jis maal ka koi muaeeyan malik na hu ussy bait ul maal mai jama'a kara dia jata hai.
