Question :
Orat mutalqa kab shumar hogi? aur talaq k jawaz mai kia himat hai?
Answer :
Orat ko us wqt mutalqa samjha jayega jab us ka shoher mukalaf-o-mukhtar hu aur woh apni bivi ko talaq dey aur talaq k waqu mai janoon ya nasha wagaira koi amar many bhi na hu. aur agar shoher majnon hu ya issy majbor kiya gaya hu ya woh nashy ki halat mai hu ya woh is qadar shadeed gussey ki halaat mai hu, jis sy insan madhosh sa hujata hai, k talaq k muqsan ko samjhny sy ajiz hu, wazeh asbab bhi is halat sy taeed kerty houn k is ny shadeed gussey mai talaq di hai, mutalqa bhi is baat ki tasdeeq kery ya mua'atbir gawahi sy iski tasdeek hu to oulama k sahi qaul k mutabiq is sorat mai talaq waqey na hogi Qk Nabi Akrem (S.A.W) ny farmaya hai:

"shakhs merfo'u alqalam hain: 1 sowya howa hatta k baidar hujaye 2 Bacha hatta k balig hujaye 3 aur majnon hatta k samjhny lagy."
sanan abi daud' hadis: 4403' wa jamia at'tramzi ' hadis: 1423.
Irshad bari Ta'ala hai:

"Jo shakhs emaan lany k baad Allah k sath kuffar kary (es per Allah ka bara gazab hai magar) woh nahi jo majbor kia jaye aur is ka dil emaan k sath mutmaeen hu."
Alnahel 16:106.
jab es shakhs ko kafir qarar nahi dia ja sakta jissy kuffar per majboor kia gaya hu aur is ka dil emaan k sath mutmaeen hu to us shakhs ki talaq to bilaolaw waqey na hogi jis ny mahez jaber (zaberdasti) ki wajah sy talaq di hu Qk NAbi Akrem (S.A.W) ny farmaya:

"Jaber ki talaq aur azaadi kuch nahi hai."
Ahl-e-ilm ki aik jamat ny, jis mai imam ahmed Rehmat-ul-Allah Alleh bhi hain, is hadis mai warid lafaz "Aglaag" k maeeni jaber aur gussah k liye kiye hain, khalifa Rashid HAzrat Usman R.A. aur Ahl-e-Ilm ki aik jamat ny yh fatwa dia hai k aisy nashy mai madhosh shakhs ki talaq waqey nahi hogi jis ny is ki aqal ko mavif ker dia hu, agarcha nashy ki wajah sy gunaahgaar hoga.
TAlaq k jawaz mai hikmat to behad wazeh hai k kabhi bivi shoher k munasib nahi hoti aur kabhi shoher bohat sy asbab, MAslan: za'af aqal, za'af deen ya beadbi ki wajah sy bivi sy nafrat kerta hai, Allah TA'ala ny is k liye kushadgi ka tareeka yh rakha hai k issy talaq dey ker apni esmat (zojeyat) sy kharij ker dey, Irshad bari Ta'ala hai:

"Aur agar miaan bivi (mai mufavqat na reh saky aur) aik dosrey sy judda hujayen to Allah her aik ko (dosrey sy) apny fazal sy beniyaz ker deyga aur Allah hamesha sy wusat wala, kamaal hikmet wala hai." (shiekh ebn baaz)
