Sawal mai mazkora orat eddat guzarey. iski eddat 4 maah 10 din Allah TA'ala k is irshad k amoom mai dakhil hai:
Al Bakra 2:234.

"Aur tum mai sy jo log fout hujayen aur biviyan chor jayen inki bbiviyan apny app ko 4 maah aur 10 din intezar mai rakhen."
Orat k mamer huny aur hamal ki salahiyat na rakhny k bawajod is k eddat guzarny ki hikmat uqad nikkah ki ta'azeem, is ki qadar-o-monzilet aur sharf-o-bazurgi ka izhar, naiz khawand k haq ki adaigi aur tazeen-o-tajmeel sy perhaiz ker k is ki wafat k natejay mai murtab huny waly asraat ka izhar kerna maqsood hota hai, issy liye shariyat ny baap aur bety sy kahiin ziadah khawand ka soug manany ko mashrou qarar dia hai. hamla orat ki eddat faqt wazeh hamal hai.
Qk Allah Ta'ala ka yh hukam aam hai:

"aur hamla orton ki eddat wazeh hamal hai."
At'talaq 65:4.
Aur yh ayaat Allah Ta'ala k derj zail farman k amomi hukam ki takhsees ker rahi hai:

"Aur tum mai sy jo log fout hujayen aur biviyan chor jayen inki bbiviyan apny app ko 4 maah aur 10 din intezar mai rakhen."
Al bakra 2:234.
Wazeh hamal sy eddat khatam huny ki hikmat yh hai k chonkey hamal pehly khawand ka haq hai, agar hamla orat ny khawand ki wafat ya kisi aur wajah sy judai k baad foran nikkah ker lia to dosrey khawand ny apna pani gair ki kheti ko pilaya aur yh jaiz nahi hai Qk App (S.A.W) ka irshad hai:

"Kisi musalman k liye jo Allah aur roz-e-akhret per emaan rakhta hia yh jaiz nahi hai k woh apna pani gair ki kheti ko pilaye."
sanan abi daud' hadis: 2158' wa jamia At'tramzi' hadis: 1131' wa masnad ahmed: 4/108.
aik musalman per sharai aihkam ki takmeel kerna zarori hai, issy in aihkam ki hikmat ka ilm hu ya na hu. issy is baat ka yaqeen hona chaheye k Allah Ta'ala apni jumla mashroaat mai hakeem hai, jissy Allah Ta'ala hikmat ki ma'arfat ata farma dey to yh Noor alla Noor aur sarapa kher hai.

Jab kisi musalman mulazim orat ka shoher fout hujaye aur woh kisi aisy mulk mai row rahi hu jahan kisi qareebi ki wafat per 3 din sy ziadah rukhsat na milti hu to woh kis tarha eddat guzarey? Es orat ko chaheye k tamam arsa eddat mai sharai eddat aur soug ki pabandi kery. woh orat din k wqt apny kaam kaaj k liye ghar sy bahir ja sakti hai Qk yh bhi aik aihem zarorat hai. uolama na farmaya hai k edat wali orat k liye zarorat ki wajah sy ghar sy bahir nikalna jaiz hai aur rozi kamany k liye kam kerna aik aihem zarorat hai aur agar issy rozi kamany k liye raat k wqt duty per jany ki zarorat hu to yh bhi jaiz hai ta k issy mulazmat sy berkhast na ker dia jaye aur mulazmat sy berkhast huny ki sorat mai jo nuqsanat hain, woh makhvi nahi hain lekin shart yh hai k waqai kaam kerny k liye muhtaj aur zarorat mand hu. ulama ny aisy bohat sy asbab biyaan farmai hain jis ki wajah sy eddat wali orat k liye apny ghar sy bahir nkalna jaiz hai aur in mai sy baaz asbab majbori ki wajah sy kaam per jany ki nisbet bohat kam ter hain aur is silsaley mai asal yh irshad bari TA'ala hai:

"Soo jahan tak hu saky Allah sy daro."
Aur Nabi Akrem (S.A.W) ny farmaya:

"Jab mai tumhain kisi cheez ka hukam doun to jahan tak hu saky isko baja lau." (shiekh ebn baaz)

Jis orat ka khawand fout hujaye issy kin aihkamat ka eltazam kerna chaheye?
Answer :
Hadis ki rou sy soug manany wali orat per chand amoor ka eltazam kerna zarori hai:
1: Jis ghar orat ka khawand fout huwa, eddat khatam huny tak woh issi ghar mai muqem rahygi. eddat ki mudat 4 maah 10 din hai.
Irshad Bari Ta'ala hai:
"tum mai sy jo log fout hujaye aur biviyan chor jayen woh ortain apny app ka 4 maheeny aur 10 din edat mai rakhen."
Al BAkra 2: 234.
Orat k hamla huny ki sorat mai iski eddat wazeh hamal hai. wazeh hamal k sath hi orat ki eddat khatam hujayegi.
Daimi Fatwa cammettie cammettie ny aik fatway mai mazeed wazahet ki hai k bewah k hamla huny ki sorat mai iski eddat sirf wazeh hamal hi hogi 4 maah 10 din nahi hogi (wazeh hamal khuwah jild hujaye ya badeer.)
Irshad bari Ta'ala hai:

"Aur hamla orton ki eddat wazeh hamal hai."
At'talaq 65:4.

2: orat eddat k ayaam mai khoubsorat libaas zaib tan kerny sy perhaiz kery, woh bharkeela zard ya sabaz rang ka libaas na pehny balky issy sadah libass istemal kerna chaheye agarcha woh siyaah hu ya sabaz wagaira, maqsad yh hai k kaprey khousorat nahi huny chaheye, Nabi (S.A.W) ka yahi farman hai.
Hazrat Umme Atiya R.A. sy ravayat hai k Rasool Allah (S.A.W) ny irshad farmaya:
"koi orat khawand k siwa kisi maiyet per 3 din sy zaid soug na manaye, khawand ki wafat per 4 maheeny 10 din tak soug manaye, is doran rangdar (shoukh-o-bharkely) kaprey na pehny, Siwaye langote k, na surma lagaye, na khushbo istemal kery, haan haiz sy farig huny per (sharam gaah per) khushbu istemal ker sakti hai."
sahi muslim' hadis: (66)-938 baad alhadis: 1491.
3: Orat eddat k doran mai sonu, chandi, heeron aur motiyo k zaiwrat pehan'ny sy ejtanab kery, aisy zaiwrat haar ki sorat mai houn, kangan ki sorat mai ya angothi wagaira ki sorat mai (sab mamno hain.)
Tanbeeh: Daimi fatwa cammettie sy ghari pehnanay ki babut sawal deryaft kia gaya jo sirf wqt dekhny ki niyat sy hu, barai hasol zeenat na hu to cammettie ka jawab yh tha k aisa kerna jaiz hai lekin yh zaiwer sy mushaba hai issy na pehna jaye to behter hai.

5: Surma lagany sy ejtanab kerna, orat doran eddat surma bhi nahi laga sakti, chehrey k makeup k liye istemal huny wala saman, jo k mardo k liye baees fitna hu, bhi surmey ka hukam rakhata hai, lehaza makeup kerny sy bhi perhaiz kery, Albatta aam istemal wali ashiya, Maslan: pani aur sabun wagaira k istemal mai koi harj nahi. lekin woh surma jo ankhu ko khubsorat bana daita hai aur dosri aisi cheezain jo baaz khawateen apni chehrey k hussan k liye istemal kerti hain, yh sab najaiz hai. Yh 5 ashiya hain jin ka aihtamam kerna her es orat per wajib hai jo khawand ki wafat per eddat k din guzar rahi hu. baki raha baaz logo ka yh kerhna k woh kisi sy gutagu nahi ker sakti, telephone per kisi sy baat nahi ker sakti, haftey mai aik sy zaid baar gusal nahi ker sakti, ghar mai nangey paon nahi chal sakti aur na chand ki poshni mai bahir nikal sakti hai to yh sab kharafat hain, is tarha ki fazoliyat ka islam mai koi wajood nahi. woh ghar mai nangey paon chal sakti hai. chat per ya ghar k bageechey mai jahan chahey chand ki roshani mai chal pher sakti hai, jab chahey gussal ker sakti hai, jis sy chahey shareefana aur bawaqar guftagu ker sakti hai, apny mehram rishty daro aur dosri orton sy musahifa ker sakti hai, haan gair mehram mardo sy musahifa nahi ker sakti.

MUTALQA KI EDDAT AUR MUTELQA RAJAIYA KA GHAR SY NIKALNA

Question :
Aik sail ny yh sawal pocha hai k mutalqa ki eddat kia hai? naiz woh mutalqa jis ki talaq raji hu kia woh apny shoher hi k ghar rahy ta k is ka shoher rajou ker saky ya woh apny walid k ghar chali jaye?
Answer :
Jis mutalqa ki talaq raji hu, is k liye yh wajib hai k woh apny shoher hi k ghar mai rahy aur shoher k liye issy ghar sy nikalna haram hai. Irshad Bari TA'ala hai:

"Na to tum (hi) in ko (ayaam eddat mai ) in k gharo sy nikalu aur na woh (khud hi) niklain, haan agar woh sureeh behayai (badkari) karen (to nikal daina chaheye) aur yh Allah ki haden hain, jo koi Allah ki hadu sy tajawuz keryga woh apny app per zulm keryga."
At'alaq 65:1.
Ajj kal mai jo yh rivaj hai k jonhi kisi orat ko raji talaq huwi woh foran apny waldain k ghar chali jati hai, yh galat aur haram hai Qk Irshad Bari Ta'ala hai:

"Na to tum (hi) in ko in k gharo sy nikalo aur na woh (khud hi) niklain."
At'talaq 65:1.
aur estashna ki sirf yh aik sorat biyan ki hai k agar woh sureeh bahayai (zina) ka irtekaab karen to phir inhain gharo sy nikal daina chaheye aur phir is k baad farmaya:

"Yh Allah ki hadain hain aur jo shakhs Allah ki hado sy tajawuz keryga, woh apny app per zulam keryga."
At'talaq 65:1.
phir is k baad Allah ta'ala ny shoher k ghar hi mai rehny ki hikmat ko biyan farmaya hai:

"Tou nahi janta shayet Allah is k bad koi (raja'at ki ) sabeel paida farma dey."
At'talaq 65:1.
Musalmano per wajib hai k Woh Allah TA'ala ki muqarar kerdah hadod ki pabandi karen, Allah Ta'ala ny inhain jo hukam dia hai usko baja layen aur mahez adaat kosharai amoor ki mukhalfat ka zariya na banain, lehaza raji talaq wali orat k liye wajib hai k woh eddat puri huny tak apny shoher hi k ghar mai rahy aur is doran mai woh shoher sy perda bhi nahi kary gi balky is k samny izhar zaib-o-zeenat aur aihtamam aaraish-o-zaibaish bhi ker sakti hai, donu bahum deegar guftagu bhi ker sakty hain aur ekathy beth bhi sakty hain aur mubashret k siwa her kaam ker sakty hain, mubashret sirf rajou k wqt hi ker sakty hain aur rajou ki sorat yh hai k shoher zubaan sy kahey k mai apni bivi sy rajou kerta hoon, naiz woh maraza'at ki niyet sy mubashret ker k amlan bhi rajou ker sakta hai.
Mutalqa ki edat k bary mai hukam yh hai k agar kisi orat ko dakhol-o-khelwat, yani jama'a-o-mubashret sy qabal talaq dey di gae hu to is k liye mutalqan koi eddat nahi hai, Woh mahez talaq hi sy bahna hujayegi aur kisi dosry mard sy shadi kerna is k liye halaal hujayega aur agar dakhol-o-khalwet aur maza'at k baad talaq di hu to phir eddat ki hasb zail soratian hougi:
1: Agar orat hamla hu to is ki edat wazah hamal tak hai, khuwah yh mudat kam hu ya ziadan mumkin hai k aik shakhs ny apni bivi ko subha k wqt talaq di hu aur zuher sy pehly bachy ko janam dey day to is ki eddat issi sy puri hujayegi aur is baat ka bhi imkaan hai k aik shakhs ny maa muharram mai apni bivi ko talaq di hu aur is k haan bavhy ki viladat zulHijjah k maheeny mai hu to aisi orat ko 12 maah ki eddat guzarni hogi Qk is bary mai asool yh hai k hamla ki eddat wazeh hamal hai, jaisa k Irshad BAri TA'ala hai:

"Aur hamal wali orton ki eddat wazeh hamal (bacha jan'nay) tak hai."
At'talaq 65:4.
2: Agar mutalqa orat hamla nahi aur issy haiz aata hu to is ki eddat talaq k baad mukammal 3 din haiz hai, yani issy haiz aye aur pak hujaye, phir aye aur pak hujaye aur phir aye aur pak hujaye, yani is tarha mukammal 3 haiz ayen, khuwah in k dermiyan ki mudat kam hu ya ziada, maslan: agar koi shakhs maza'a (bachay ko doodh pilany wali) ko talaq dey dey aur issy 2 saal tak bhi haiz na aye to woh eddat mai hi rahygi hatta k issy 3 baar haiz aajaye aur is tarha issy 2 saal ya is sy bhi ziadah arsey tak eddat mai rehna par sakta hai Qk Irshad Bari Ta'ala hai:

"aur talaq wali ortain 3 haiz tak intezar karen."

3: Jis orat ko haiz na ata hu, khuwah is ka sabab adem balogat hu ya kaber suni, kisi bhi wajah sy haiz sy mayosi hu to is ki eddat 3 maah hai. Irshad BAri Ta'ala hai:

"aur tumhari (mutalqa) oratain jo haiz sy naumeed hu chuki houn agar tum ko (in ki eddat k bary mai) shubah hu to in ki eddat 3 mahiny hai aur jin ko abhi haiz nahi aany laga (in ki eddat bhi yahi hai.) "
At'talaq 65:4.
4: Agar kisi ka haiz kisi sabab ki wajah sy khatam hugaya hu aur maloom hu k ab haiz kabhi nahi ayega, MAslan: yh k operation wagaira k zariye is ka reham hi nikal dia gaya hu to yh bhi haiz sy mayous orat ki tarha 3 maah eddat guzary gi.
5: Agar haiz khatam hugaya hu aur issy is k sabab ka bhi ilm hu to issy intezar kerna hoga hatta k yh saba dour hujaye, haiz aajaye aur yh is k mutabiq eddat guzarey.
6: Haiz khatam hujaye magar orat ko is k sabab ka ilm na hu to ulama farmaty hain k issy mukammal aik saal tak eddat guzarni chaheye is mai 9 maah hamal k aur 3 maah eddat k hougey. yh hain mutalqa orton ki eddat ki iqsaam.
jis orat ka nikkah khla wagairah ki wajah se faskh ho gaya ho is ki eddat aik haiz hai, yani, jab koi shaks apni bivi se khla kry k is orat ne ya is k wali ne kuch maal de diya ho k is k ewaz wo nikkah kr de aur shoher ne maal wagairah le ker orat ko alag ker diya ho to isy eddat k liye aik haiz hi kafi hai. wallah al mofaq. Mai aik mamoli si baat per apni bivi sy sakht gussah huwa aur jab gussah thanda huwa to meri bivi ny mujhy bataya k mai ny issy gussey ki halat mai aik talaq dey di hai, mai ny beth ker yaad kerna shoru ker dia k kia mai ny issy talaq di hai ya nahi lekin is k bary mai mujhy mukammal tour per yaad nahi aur bivi ko talaq dainy ki meri koi niyyat bhi na thi magar zubaan lagzish kha gae, qasd-o-iradah k bagair gussah galib aagaya or cunkay mujhay ye bhi yaqin tha kay meri bewi nay jhot nhi bola,lyhaza mian nay rajo kar lia hay or phir bad mian hasby mamul zandagi basar karna shoru kar di.ab jabkay ia par aik waqt guzar chuka hay,tarhan tarhan kay waso say daman gir hay,lyhaza ap say omid karta hun kay ap fatwa ata farmain gey k kia mazkora halat mai talaq waqey hujati hai? aur agar talaq waqey hujati hai to kia mazkora tareekay sy mera rajou kerna sahi hai? naiz is sorat mai mery liye kia lazim hai? yh bhi yaad rahy k yh aik raje talaq thi aur eddat ki mudat khatam hu chuki hai?

Marajaz'at sahi hai bashart yh k eddat k ander waqey huwi hu aur sunnat yh thi k app 2 gawahon ko bhi is per shahid thera laity Qk Irshad bari Ta'ala hai:

"Phir jab woh apni meyad (inqazai eddat) k qareeb pohanch jayen to in ko achi tarha sy zojiyat mai rehny do ya achy tareekay sy alaihda ker do aur apny mai sy 2 munsif mardon ko gawah ker lo aur (aye gawahu!) tum Allah k liye darust gawahi daina."

Ahl-e-Ilm ny is ayaat kareema sy estadlal kia hai k talaq-o-raja'at k liye gawahi mashrou hai, lehaza ziada ehtiyat issi mai hai k app issy talaq shumar karen aur is k waqey huny ka aitbar karen Qk app ny sawal mai kaha hai k app ki bivi ny app ko yh yaad dilaya aur apko is ki baat per yaqeen hai aur phir NAbi Akrem (S.A.W) ny farmaya:

"Jo shakhs shubhat sy bach gaya is ny apny deen-o-ezzat ko bacha lia."
sahi albukhari' hadis:52' wa sahi muslim' hadis:1599 wallafaz laahu.
Naiz App (S.A.W) ka yh bhi irshad grami hai:

"Jo cheez tujhy shak mai dakey ussay chor ker us cheez ko ikhtiyar ker jis mai shak na hu." (shiekh ebn baaz)
Jamia At'tramzi' hadis: 2518' wa sanan al kubra lilnasai' hadis:5220.
Tanbeeh: As'shiekh ebn esimeen REham ul Allah ny bhi aik fatway mai rajou k wqt gawah banany ko sunnat qarar dia hai

Aik admi ny apni bivi ko talaq sunnat di, phir issy talaq nama bhi dy diya aur ab rajou kerna chahta hai, kia orat ki raza mandi k bagair jaber sy bhi rajou hu sakta hai? ya rajou orat ki raza mandi per moquf hai? kia rajou k liye kuch sharait bhi hain?
Answer :
Agar amar waqai issy tarha hai jis tarha ziker kiya gaya hai to shoher ko rajou ka haq hasil hai bashart yh k woh orat eddat mai hu aur 2 adil gawaah majood houn, khuwah bivi razi hu ya na. aur agar eddat khatam hugae hu aur yh teesri talaq na hu to issy orat ki raza mandi sy naye nikkah aur naye maher k sath rajou ka haq hasil hai. mazkora donu sorato mai yh aik talaq shumar hogi.
Aur agar yh teesri talaq hu to phir yh orat is wqt tak halaal nahi hogi jab tak yh kisi dosry shoher sy sharai nikkah na kery aur woh is sy muqarbet bhi kery. aur jab yh dosra shoher bhi issy talaq dey dey ya fout hujaye to phir yh pehly shoher k liye halaal hogi, woh eddat khatam huny k baad naye uqad aur naye maher k sath orat ki raza mandi sy is k sath shadi ker sakta hai. HAmla ki eddat waza'a hamal hai, khuwah orat mutelqa hu ya is ka shoher fout shudah hu, is gair hamla ki eddat jis ka shoher fout shodah hu 4 maah 10 din hai aur agar mutalqa hu aur haiz ata hu to eddat 3 haiz hai aur agar bari umer ki waja sy haiz na ata hu ya haiz ki umer sy choti hu to eddat 3 maah hai.
